Non-Compete Contracts Enforced by Illinois Supreme Court, Strengthening Position of Employers

In Reliable Fire Equipment Co. v. Arnold Arredondo, 2011 III. LEXIS 1836 (December 2011), the Illinois Supreme Court reversed a ruling by a trial court after a trial. The trial court had refused to uphold a restrictive covenant, ruling that no legitimate business interest was served by the provision. The Illinois Supreme Court reversed that decision, holding that the totality of the circumstances should have been considered.
