Real Estate Development Litigation: Called in a Crisis

We met a real estate developer who was being sued for over a million dollars for fraud, breach of fiduciary duty, breach of contract, and related theories. His attorney had cancer and had to withdraw. His accountant recommended us to replace the attorney. We filed our appearance shortly after getting the client’s file in mid-October, and the trial was scheduled two weeks later. About six boxes of documents had to be reviewed, organized and made exhibit-ready.  In that short time, the team had to analyze a real estate development and construction contract, a commercial lease, a Limited Liability Company, and the Limited Liability Company Act.

The opposing attorney was very skillful and persistent and tried to overwhelm us with a plethora of motions, but had ultimately misanalyzed the case.  After a nine-day bench trial, we won across the board –defeating every theory brought against us– even winning our counterclaim on the lease.
