Martha Stewart Living and Macy’s Settle Breach of Contract Lawsuit

After three years of litigation related to Macy’s breach of contract lawsuit against Martha Stewart Living Omnimedia, the two companies have decided to settle and continue their partnership moving forward.

The settlement stems from a long legal battle wherein Macy’s (which had an exclusive partnership with Martha Stewart) filed separate suits against both Martha Stewart Living Omnimedia and J.C. Penney after discovering the companies had signed a merchandising agreement.

While J.C. Penney and Martha Stewart have significantly scaled back their level of partnership (J.C. Penney has eliminated several categories from the Martha Stewart line from being sold in its stores), Macy’s lawsuit against J.C. Penney continues.

According to The New York Times, the suit should not be affected by the settlement nor Macy’s and Martha Stewart Living’s decision to move forward with their partnership.

While both Martha Stewart Living and J.C. Penney continue to show signs of duress (as we have mentioned in previous posts), Macy’s has seen even larger profit margins than were predicted.
